The University at Buffalo Information Technology (UBIT) operates as a covered entity as defined by the U.S. Department of Health and Human Services Office of Civil Rights. HIPAA Regulation Text 45 CFR Part 164.508 requires that covered entity, unless otherwise permitted or required by 164.508, not use or disclose ePHI without a valid authorization.

Policy

UBIT does not use or disclose ePHI without valid authorization, unless otherwise permitted or required, as described in HIPAA Regulation Text 45 CFR Part 164.508.

UBIT uses and discloses ePHI consistent with its valid authorization to do so. 

Applicability

This policy applies to all UBIT workforce members.

Responsibility

Workforce members: Adhere to policies and procedures as written.

HIPAA Security and Privacy Officer: Ensures that ePHI is not used or disclosed without valid authorization, unless otherwise permitted or required, as described in HIPAA Regulation Text 45 CFR Part 164.508.

Compliance Officer: Participates in ensuring the security of ePHI is effective and enforced, in conjunction with the HIPAA Security and Privacy Officer.
