The University at Buffalo Information Technology (UBIT) operates as a covered entity as defined by the U.S. Department of Health and Human Services Office of Civil Rights. HIPAA Regulation Text 45 CFR 164.312(c)(1) requires a covered entity to implement policies and procedures to protect ePHI from improper alteration or destruction.

Policy

UBIT’s risk analysis, in accordance with its Risk Analysis Policy, is used to determine which types of ePHI will be authenticated. The risk analysis is also used to determine reasonable and appropriate electronic mechanisms used to validate that ePHI has not been altered or destroyed. UBIT implements these electronic mechanisms used to validate that ePHI has not been altered or destroyed.

Applicability

This policy applies to all UBIT workforce members.

Responsibility

Workforce members: Adhere to all policies and procedures as written.

HIPAA Security and Privacy Officer: Ensures that whenever possible, electronic mechanisms to corroborate that ePHI has not been altered or destroyed in an unauthorized manner have been implemented.

Compliance Officer: Participates in ensuring the security of ePHI is effective and enforced, in conjunction with the HIPAA Security and Privacy Officer.
