Politico features the expertise of Clayton Masterman regarding recent wins in nuisance lawsuits against social media platforms that can spread misinformation and harm the mental health of young users. Masterman explained that the courts must prove that these platforms are a nuisance by balancing the costs and benefits to society, which, he notes, “is going to be tricky. You will probably have expert witnesses try and offer testimony about the magnitude of those harms of benefits on both sides, and see where it shakes out in the end.”
